Religious Forum Nepal has been doing series of serious consultation with religious leaders, civil society’s leaders, human rights activists regarding provision of freedom of religion and belief in upcoming constitution. It urges all the concern stakeholders to publish this press release to make sure that it draws attention of all Constitution Assembly (CA) members in Nepal.
There are antagonist and unexpected incidents caused by handful individual and groups trying to fulfil their own stakes rather than goodness of nation and people has brought into our attention. New constitution should lead nation into prosperity, opening door for all kind of possibilities. It should guarantee feeling, thoughts, rights and responsibilities by accepting existence of people from all backgrounds equally. New upcoming constitution should be able to address all people of Nepal.
Concerning Nepal being one of the member organizations of United Nations, state should fulfil its commitment towards international conventions that Nepal is party to. It is a first most privilege of every person to have rights to freedom of religion or belief. Universal Declaration of Human Rights (UDHR) article 18 allows a person to change his/her religion or belief (conversion). International Covenant on Civil and Political Rights (ICCPR) article 18 and its clauses has further supported such freedom.
We are worried about debates on secularism and religious freedom brought unnecessarily. Despite of fact that secularism being a typical political agenda, it has been made needlessly popular issues to discuss about. A very simple meaning of secularism is state just to be neutral towards all kinds of religion and its cultures. A person can or cannot have faith on a religion or belief, person may like or not to follow a religious agendas but state is not an individual person, it is an institutionalized legal guardian to all people from diverse cultures living under its jurisdictions and territory. Therefore, state cannot follow a particular religious belief as an individual. State is an institution that meet the need of people by using its political power. Hence, state should be understood as it cannot be privileged towards any particular religious communities.
There are high possibility of rights of religious freedom being incomplete when state is being relative to a particular religion of belief. In secular state, there will be full guarantee of “freedom of religion or belief” for people from all belief to enjoy their rights. Hereafter, we different religious communities, for the sake of all Nepalese people; lover of peace and justice, appeal to political parties, Constitution Assembly (CA), government of Nepal and concern stakeholders to come in solidarity for making sure full rights of religious freedom in new constitution of Nepal towards the national glory, prosperity, respecting people and nation appropriately.

धार्मिक चौतारी नेपालकले हालै विभिन्न धार्मिक समुदायका गुरूजनहरू, नागरिक समाजका अगुवाहरू र मानव अधिकारकर्मीहरूको समुपस्थितिमा अहिले बन्न लागेको नयाँ संविधानमा धर्म तथा आस्थाको स्वतन्त्रता विषयमा गम्भीर विचारविमर्श गरी संविधानसभा सदस्यहरूका हातमा पर्नेगरी अपील गरेको व्यहोरासहित समाचार प्रकासन तथा प्रसारणका लागि यो विज्ञप्ति पठाइएको अनुरोध गरिन्छ ।
सबै सम्पूर्ण नेपाली जनता र समग्र नेपाल राष्ट्रको हित खोज्नेभन्दा पनि आ–आÇनै इच्छा–चाहना पूरा गर्नका लागि केही व्यक्ति तथा समुहहरूले थालेका विरोधका अभियानहरूसाथै अनपेक्षित घटनाहरूप्रति हाम्रो गम्भीर ध्यानाकर्षण भएको छ । नयाँ संविधानले देशलाई प्रगतिको मार्गमा डो¥याउने सबै सम्भावनाहरूको दैलो उघार्नुपर्छ । यसले सम्पूर्ण देशवासीहरूको समान अस्तित्व स्वीकार गर्दै सबैका भावना, विचार, हक–अधिकार र नागरिक कतव्र्यहरूको ग्यारेण्टी गरिदिनुपर्छ । अब बन्ने संविधान सबै नेपालीका लागि बन्नुपर्छ, यो कसैका लागि बन्ने होइन, यसले सबैको हितलाई समेटेको हुनुपर्छ ।
नेपाल विश्वका सबैजसो राष्ट्रहरूको छाता संस्था संयुक्त राष्ट्र संघको सम्मानित सदस्य हो, र त्यही हैसियतमा राज्यले विश्वसामु गरेका सबै सन्धी–सम्झौता र प्रतिबद्धताहरूको गम्भीरतासाथ पालन गर्नुपर्दछ । प्रत्येक व्यक्तिको धर्म तथा आस्थाको स्वतन्त्रतासम्बन्धी अधिकार सबैभन्दा पहिलो अधिकार हो । यसर्थ धर्म वा आस्थाको स्वतन्त्रतासम्बन्धी हकलाई मानव अधिकारकै आधार मानिन्छ । मानव अधिकार विश्वव्यापी घोषणापत्रमा “प्रत्येक व्यक्तिलाई आफ्नो विचार र सुविवेकअनुसार कुनै धर्म मान्ने स्वतन्त्रता हुनेछ । यसमा व्यक्तिले एक्लै वा समुदायका अरूसित मिलेर व्यक्तिगत वा सार्वजनिकरूपमा आफ्नो धर्म वा आस्थाको अवलम्बन गर्न, अभ्यास गर्न, प्रचार गर्न, शिक्षा दिन, आराधना गर्न वा अन्य धर्म वा आस्था ग्रहण गर्न (धर्मपरिवर्तन) पाउने अधिकारसमेत समावेश हुनेछ” (धारा १८)। त्यसैगरी नागरिक तथा राजनीतिक अधिकारहरूको अन्तरराष्ट्रिय प्रतिज्ञापत्र (धारा १८, उपधारा १) मा पनि सोही आशयलाई दोहो¥याइएको छ । सो प्रतिज्ञापत्रको धारा १८, उपधारा २, ३ र ४ मा व्यक्तिको धर्म वा आस्थाको अवलम्बन तथा अभ्यासको सन्दर्भलाई अझै प्रष्टसाथ लेखिएको छः (२) कुनै पनि व्यक्तिले आफूले इच्छाएको धर्म वा आस्था ग्रहण गर्न वा अवलम्बन गर्न पाउने स्वतन्त्रताबाट कसैले पनि उसलाई जोर जबरजस्ती बञ्चित गर्नु वा गराउनु हुँदैन । (३) आफ्नो धर्म वा आस्थाको स्वतन्त्रताको अभ्यास गर्दा प्रचलित कानुनले तोकेअनुसार उलंघन नहुने गरी गर्नुपर्छ, यसो गर्दा अरू कसैको मौलिक अधिकार हनन् हुनेगरी तथा सार्वजनिक सुरक्षा, शान्ति, स्वस्थ्य वा नैतिकता भड्ड हुनेगरी गर्नुहु“दैन । (४) यो प्रतिज्ञा ग्रहण गर्ने पक्ष राष्ट्रले आमा–बाबु वा वैधानिक अविभावकहरूले आफूले मानिआएको विश्वासअनुसारको धर्म तथा नैतिक शिक्षा आफ्ना बालबालिकाहरूलाई सिकाउन पाउने अधिकारको सम्मान गर्नुपर्दछ” (अनुवाद)।
त्यसैगरी धर्मनिरपेक्षता तथा धार्मिक स्वतन्त्रताको विषयमा अहिले अनावश्यक विवाद सिर्जना भएकोप्रति हामी चिन्तित छौँ । धर्मनिरपेक्षता नितान्त राजनीतिक विषय हुँदाहुँदै पनि अहिले यसलाई अनावश्यक चर्चाको विषय बनाइएको छ । राजनीतिमा धर्मरिपेक्षताको सोझो अर्थ राज्यले धर्म वा धार्मिक संस्कारप्रति आफूलाई निस्पक्ष उभ्याउनुपर्छ भन्ने मात्रै हो । एउटा व्यक्ति कुनै धर्मप्रति आस्थावान हुन वा नहुन सक्छ, कुनै धार्मिक मतको पक्षमा ऊ खुलेर लाग्न वा नलाग्न सक्छ । तर राज्य व्यक्ति होइन । राज्य असंख्य व्यक्तिहरूको अविभावक संस्था हो । राज्यले व्यक्तिसरह कुनै धर्मको अनुशरण गर्नुपर्छ भन्न मिल्दैन । राज्य भनेको राजनीतिक शक्तिको प्रयोग गर्दै व्यक्ति–व्यक्तिहरूका निम्ति आवश्यक सेवा प्रदान गर्ने संगठित संस्था हो । त्यसकारण राज्य कुनै धार्मिक सम्प्रदायको पक्षपाती हुनुहुँदैन भनिएको हो भनी बुझ्नुपर्छ ।
कुनै एउटा धर्मप्रति मात्रै सापेक्ष रहने राज्यमा धार्मिक स्वतन्त्रताको अधिकार अपूर्ण रहने सम्भावना प्रबल रहने हुँदा धर्मनिरपेक्ष राज्य बनेमा “धर्म तथा आस्थाको स्वतन्त्रता” हकको पूर्णतः उपभोग गर्न सबै आस्था तथा धार्मिक समुदायका मानिसहरूलाई समान अवसर प्राप्त हुन सक्दछ । त्यसर्थ राष्ट्रिय सम्मान, उन्नति तथा समृद्धिका निम्ति देशका जनताहरूलाई सबैभन्दा बहुमूल्य सम्पत्तिका रूपमा यथोचित सम्मान दिँदै नयाँ संविधानमा पूर्ण धार्मिक स्वतन्त्रताको अधिकार ग्यारेण्टी गराउने लक्ष्यतर्फ एकबद्ध हुनका लागि हामी विभिन्न धार्मिक समुदायहरू मिलेर सम्पूर्ण शान्तिप्रेमी, न्यायप्रेमी नेपाली जनताहरूको अधिकतम हितको पक्षमा सबै राजनीतिक दलहरू, सम्मानित संविधानसभा, नेपाल सरकार तथा सम्बन्धित सरोकारवालाहरूसमक्ष हार्दिक अपील गर्दछौं । धन्यवाद ।
